This Agreement describes the Terms and Conditions which you, as a User accept by using our itecsourcing.com Website. This document is a legally binding agreement between you as the user(s) of the Website (referred to as “you”, “Customer” or “User” hereinafter) and ITwebdesign B.V. (referred to as “we” or “our” hereinafter).

Please, read these terms and conditions carefully before you start to use the Website! By using the Website, you accept and agree to be bound and abide by these Terms. If you do not want to agree to these Terms, we suggest you to leave this Website.

We keep the right to revise and update these Terms and Conditions from time to time at our sole discretion. We encourage you to check this page frequently. Your continued use of the Website following the posting of revised Terms and Conditions indicates your acceptance and agreement to the changes.

I About ITwebdesign B.V.

ITwebdesign B.V. is one of the largest IT companies with Holland origins which is on the market since 2009. It offers the wide range of Services in Programming, Design and Marketing areas through online web platform http://itecsourcing.com/.

ITwebdesign B.V. is registered in Heerhugowaard, Netherlands in the Chamber of Commerce under the registration number: 64313689.

II Website Use

ITwebdesign B.V. provides access to the whole range of Services and tries to its best to make sure that all information on Website is true and accurate at all times. The introduced Services can be used by:

• Private individuals, commercial companies or non-individual corporate entity;
• People at the age from 16;
• People, who are able to form legally binding contracts;
• Users, who provide accurate personal or business information.

ITwebdesign B.V. may monitor access to the Website and is entitled to terminate the User’s access to the Website for any reason at any time.

III Services

All Services, which are represented on a Website, are completely available for Customer. Customer has a right to make an inquiry concerning his/her own project for implementation of which needs special or rare technologies.

ITwebdesign B.V. reserves the right to update or remove some of Services on its sole discretion. We keep the right to limit the provision of Services to any person according to geographic location or some actions which break the rules of our Website.

IV Process

To start working process with ITwebdesign B.V. Customer can send his/her inquiry through the specially provided forms on a Website (“Contact Us” or “Send a Project”) or at the email address. The processing time of each request takes about 24 hours (in business days).

Customer must clearly identify the aim of his/her project, stages of working process, technologies, skills and deadline for its implementation.

According to the project specifications, the needed team of developers can be built up and offered by ITwebdesign B.V. on Customer’s demands.

Customer has an opportunity personally select the employees who match the most his/her requirements on the base of CV's provided by ITwebdesign B.V.

It is possible to hire employee for full or part time job.

In case of part-time job hired employee, or team of employees, are eligible to implement only tasks according to the project and which are set in Customer’s contract. Any additional /new task should be discussed with ITwebdesign B.V. in advance. In case of implementation of additional tasks by hired employees without prior agreement with ITwebdesign B.V., the cooperation with Customer and developer can be temporary or completely suspended.

V Payment

The quotation, provided by ITwebdesign B.V. is individual for each project and depends on its complexity, duration, skills and technologies which are required for tasks implementation.

All payments should be directly credited to ITwebdesign B.V. bank account.

Before start the workflow, Customer should pay the first pre-payment in advance within three (3) business days. The rest sum – each month in advance (the sum of each payment will be indicated individually in Customers’ contract). After 100% project completement the last part of total sum should be paid within one (1) business day.

Payment (or attempt of) outside of ITwebdesign B.V. is a breach of these Terms and Conditions. Such payment (or attempt of) will lead to temporary and/ or permanent termination of cooperation with a Customer and / or developer.

VI Communication

Communication with hired employees can be hold via Skype, email or phone. Customer shouldn’t ask and/or provide his/her personal information, such as location, bank account etc. You must not, and must not attempt to communicate with or give tasks other employees, who were hired by you before and who are not involved in your current project.

VII Refusal from Services

In case of refusal from Services at any stage of working process Customer should inform ITwebdesign B.V. one (1) month in advance. In the result Customer should pay the penalty which is individual for each project/task and will be indicated in personal contract.

VIII Disputes

If a dispute arises between you and hired employee (s), our goal is to solve your concerns immediately. We strongly advise you to first contact us directly at info@itecsourcing.com.

The investigation can be done in case of providing written evidences and can be conducted by phone or email. This process shall not involve any third parties or witnesses.

IX Leaving Feedback

When the project or task is completed ITwebdesign B.V. asks to leave qualitative feedback and rating from 1-5 regarding hired employee (s). It helps us to determine the areas we must pay attention on. Customer should provide feedback honestly without any manipulation from hired expert’s side.

All feedback will be carefully investigated and publish on a Website.

X Security

All performed work completely belongs to Customer. ITwebdesign B.V. employees can work remote on Customer’s servers as well. We sign contracts with our employees and clients about intellectual property protection according to European law in Europe, so our Customers always have strong legal status.

XI Force Majeure

ITwebdesign B.V. shall not be liable for failure or delay in performing obligations hereunder if such failure or delay is due acts of nature, forces or causes beyond our reasonable control, including Internet failures, computer, telecommunications or any other equipment failures, electrical power failures, strikes, labor disputes, riots, acts of any governmental body, war or fire.

XII Prohibited Use

User can use the Website only on lawful business and in accordance to these Terms and Conditions. It is forbidden to use the Website in the following ways:

• Use any robot or other automatic device, process or means to access the Website for any purpose, including monitoring or coping any of the materials on the Website;
• Introduce any viruses, Trojan horses, worms or other materials which is malicious or technologically harmful;
• To transmit, or procure the sending of, any advertising or promotional materials, including any “junk mail”, “chain letter” or “spam” or any other similar offers;
• In any other way that violates any local or international law.

Violations:

• It is prohibited to use inappropriate language and behavior towards all employees of ITwebdesign B.V. Communication should be professional, constructive and friendly;
• It is forbidden to exchange the adult services or any pornography materials;
• It is not allowed to send any malicious content which can damage computer;
• It is forbidden to send or exchange other people private information;
• It is not allowed to exchange information which is not related to project/task.

XIII Intellectual Property Rights

You agree to use the Website solely for your own private purposes. All content, which is represented on this Website, namely, text, images, graphics, video clips, sounds, files, databases or listings etc. is the private property of ITwebdesign B.V. You agree that you will not copy, modify, download, re-publish, sell, distribute or resell any of this material. All such actions, without prior written approval by ITwebdesign B.V., are considered to be the violation of these Terms and Conditions and can lead to criminal or civil penalties.

The Website and its entire content are protected by Dutch, and international copyright, trademark, patent, trade secret and other intellectual property rights laws.

XIV Changes to the Website

ITwebdesign B.V. may change any aspect of this Website, including its content at any time with or without prior notification of its Users. ITwebdesign B.V. reserves the sole right to make changes in Privacy Policy and Terms & Conditions. Such changes are effective immediately after placing them on a Website.
